General Terms and Conditions of Sale
1. PURPOSE
These General Terms and Conditions of Sale (hereinafter "GTC") govern the contractual relationship between the paragliding school Absolute Chamonix Parapente et Speed Riding, hereinafter "the School", and any person booking a tandem flight, course, training, guided paragliding session, or purchasing a gift voucher (hereinafter "the Client").
Any booking implies unconditional acceptance of these GTC.
2. PERSONAL DATA MANAGEMENT
In France, personal data is protected notably by Law No. 78-87 of 6 January 1978, Law No. 2004-801 of 6 August 2004, Article L. 226-13 of the Penal Code, and the European Directive of 24 October 1995.
When using the website absolute-chamonix.com , the following data may be collected: the URL of links through which the user accessed the site, the user's internet service provider, and the user's Internet Protocol (IP) address.
In any case, Absolute Chamonix Parapente et Speed Riding only collects personal information about users as required for certain services offered on the website absolute-chamonix.com . Users provide this information knowingly, in particular when they enter it themselves. Users are informed whether or not providing this information is mandatory.
In accordance with Articles 38 et seq. of Law 78-17 of 6 January 1978 on data processing, files, and civil liberties, every user has the right to access, correct, and object to personal data concerning them, by submitting a written and signed request along with a copy of their identity document, specifying the address to which the response should be sent.
No personal information from users of absolute-chamonix.com is published without the user's knowledge, exchanged, transferred, assigned, or sold on any medium to third parties. Only in the event of a buyout of Absolute Chamonix Parapente et Speed Riding and its rights would the said information be transmitted to the potential acquirer, who would in turn be bound by the same obligation to maintain and modify data with respect to the user.
The website is not registered with the CNIL as it does not collect personal information.
The databases are protected by the provisions of the law of 1 July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.
3. HYPERLINKS AND COOKIES
The website absolute-chamonix.com contains a number of hyperlinks to other websites, set up with the authorisation of Absolute Chamonix Parapente et Speed Riding. However, Absolute Chamonix Parapente et Speed Riding is unable to verify the content of those websites and therefore accepts no liability in this regard.
Browsing the website absolute-chamonix.com may cause cookie(s) to be installed on the user's computer. A cookie is a small file that does not identify the user, but records information about a computer's browsing on a website. The data collected is intended to facilitate subsequent browsing on the site and to allow various audience measurements.

4. APPLICABLE LAW AND JURISDICTION
Any dispute relating to the use of the website absolute-chamonix.com is subject to French law. Exclusive jurisdiction is granted to the competent courts.
5. MAIN LEGISLATION APPLICABLE
Law No. 78-17 of 6 January 1978, as amended notably by Law No. 2004-801 of 6 August 2004, on data processing, files, and civil liberties.
Law No. 2004-575 of 21 June 2004 on confidence in the digital economy.
6. RIGHTS AND DATA SUBJECTS
In accordance with the French Data Protection Act and the GDPR, every data subject has the following rights regarding all personal data transmitted to Absolute Chamonix Parapente et Speed Riding:
- Right of access,
- Right to rectification and modification,
- Right to restrict processing,
- Right to object,
- Right to data portability.

In accordance with its legal obligations, Absolute Chamonix Parapente et Speed Riding will respond within a maximum period of one (1) month from receipt of the request.
7. SERVICES OFFERED
The School offers in particular:
- Tandem paragliding flights (discovery flight, thermal flight, high-altitude flight, etc.)
- Introductory paragliding and speed riding courses
- Advanced training courses
- Coaching days / supervised flights
- Gift vouchers
The details, content, and prices of each service are presented on the School's official communication materials (website, brochures, notices).
8. PARTICIPATION CONDITIONS
Physical fitness
The Client certifies that they are in good health and have no medical contraindication to practising paragliding.
Certain conditions (pregnancy, heart problems, severe vertigo, etc.) may result in a refusal to fly.
Age
- Tandem flights: minimum age 4 years, taking into account the child's interest and motivation.
- Minors: parental consent required.
Weight
The School may impose minimum and maximum weight limits for safety reasons and depending on the equipment used.
The maximum passenger weight for tandem flights is 120 kg fully clothed, which is the harness approval limit.
For certain flights, a stricter weight restriction may be imposed to take into account the specific characteristics of the flying sites or snow and weather conditions. Please refer to each individual flight description.
9. EQUIPMENT
The Client agrees to wear the required equipment: appropriate clothing, closed shoes, glasses, etc. The helmet and specific equipment are provided by the School.
10. BOOKING
Bookings can be made:

To be confirmed, the booking may require:
- a deposit,
- or full payment depending on the service.
11. PRICES AND PAYMENT TERMS
Prices are listed in euros, inclusive of all taxes (VAT included).
Accepted payment methods:
- Cash
- Cheques
- Bank transfers
- Holiday vouchers (Chèques vacances)
- Payment links
- Credit/debit cards for gift vouchers
The balance must be settled no later than the day of the service, unless otherwise stated.
12. VALIDITY OF GIFT VOUCHERS
Gift vouchers are valid for one (1) year from the date of purchase.
Gift vouchers are non-refundable and must be used within their validity period.
Flights from Planpraz Brévent and Plan de l'Aiguille can be booked on the dates specified on the website and gift vouchers.
Dates depend on the opening of Chamonix ski lifts. Sites are open on specific dates listed in each flight description.
"Long-haul" flights must be carried out during periods favourable to thermal currents, generally from mid-February to the end of August, within specific time slots.
It is the Client's responsibility to check these dates and book within the deadlines.
The validity period of gift vouchers cannot under any circumstances be extended, regardless of the reason why the associated flight was not taken (injury, illness, weather, etc.).
13. USE OF A GIFT VOUCHER
Absolute Chamonix gift vouchers are numbered. They are also issued in the recipient's name but may be transferred to another person subject to the agreement of the original holder.
14. CANCELLATION OR MODIFICATION CONDITIONS
14.1. By the Client
- Cancellation more than 72 hours before the scheduled date: full refund or rescheduling.
- Cancellation between 72 and 24 hours: the deposit is retained or 50% of the amount due is charged.
- Cancellation less than 24 hours before: the full service amount is due.
- No-show on the day: full service amount due.
Special cases (illness, injury, exceptional events): upon presentation of documentation, a reschedule may be offered at the School's discretion.
For gift vouchers, any rescheduling must take place within the validity period of the voucher.
14.2. By the School
Paragliding is a weather-dependent activity.
The School may cancel or postpone a service due to:
- unfavourable weather conditions,
- safety reasons,
- unavailability of staff or equipment, or ski lift closures.
In such cases:
- a reschedule will be proposed as a priority;
- if no alternative slot is available, a full refund will be issued. Gift vouchers are not eligible for refunds.
No other compensation may be claimed.
15. INSURANCE
The School holds the mandatory professional civil liability insurance covering its instructors and activities.
Each instructor is insured through the FFVL (French Free Flight Federation).
The Client is informed that:
- tandem flights are covered by the pilot's insurance;
- students on courses must hold an FFVL licence (leisure or student) including appropriate insurance.
The School may offer additional insurance where applicable.
16. LIABILITY
16.1. School's liability
The School has a best-efforts obligation. It undertakes to provide professional and qualified supervision, to comply with safety regulations, and to use compliant equipment.
16.2. Client's liability
The Client agrees to follow safety instructions.
In the event of dangerous behaviour, the School reserves the right to exclude the client without refund.
17. EQUIPMENT
Equipment provided by the School must be used in accordance with instructions.
Any damage caused by misuse may be charged to the Client.
18. RIGHT TO USE IMAGE
The Client is informed that photos and videos may be taken during flights.
With their explicit consent, these may be used by the School for promotional purposes.
19. COMPLAINTS AND MEDIATION
In the event of a dispute, the Client must contact the School by email or post to attempt to resolve the matter amicably.
In accordance with the provisions of the Consumer Code on "the consumer dispute mediation process", after contacting us and if you are not satisfied with our response, you may use the free consumer mediation procedure with:
